Official Rules and Regulations
This contest will be interpreted according to applicable Federal and Provincial law. This Contest is being conducted by YoWinner (hereafter referred to as YoWinner or the “Sponsor”).
THE CONTEST: NO PURCHASE NECESSARY
The Join YoWinner to Win Contest (the “Contest”) begins on March 25, 2009 at 12:0:01 a.m. Eastern Time and ends at 11:59:59 p.m. Eastern Time on April 28, 2009 (hereafter referred to as the “Contest Closing Date”).
ELIGIBILITY
This Contest is intended for residents of Canada who have reached the age of majority in the province or territory in which they reside as of the time of entry, excluding employees (and those with whom such employees are domiciled) of YoWinner and Promodem Media Inc (collectively, the “Contest Sponsors”). This Contest is subject to all applicable federal, provincial and municipal laws and regulations.
HOW TO ENTER
There is one way to enter the contest. Please go to www.yowinner.com and register to join the contest community. By entering the contest you will automatically receive one thousand (1,000) YoWinner points. For every thousand (1,000) YoWinners points received translates to one (1) contest entry. To increase your chances of winning by receiving YoWinner points and contest entries into the contest refer to the point breakdown below.

If it is discovered that you attempted to enter more than once per person/email address, then all your entries will be void. Entries will be rejected if entry form is not fully completed and submitted by the Contest Closing Date. Use of any automated system to enter is prohibited and will automatically result in disqualification.
THE PRIZE
There are a total of five (5) prizes available to be won, one (1) prize will be award every week for five (5) weeks. The weekly prize consists of one (1) Nintendo DS handheld game console and one (1) and one (1) Nintendo DS game, Mariokart DS. The estimated retail value of the weekly prize is $150.00 Canadian dollars.
THE DRAW
The weekly prize draw will be selected from amongst all eligible entries (one thousand (1,000) YoWinner points is equally to one (1) bonus entry) received by the Contest Closing Date. The draw will be conducted by Promodem Media, the independent Contest administration and judging organization, at or about 2:00 p.m. in Uxbridge, Ontario on the dates indicated below. The odds of winning a prize will depend on the total number of eligible online entries received.

TO WIN
In order to win the prize, the selected entrant must first correctly answer a time-limited mathematical skill-testing question to be administered by mail, e-mail or telephone. Winner will be notified by mail or telephone or e-mail and will be required to sign and return an affidavit of eligibility and liability/publicity release within ten (10) business days of notification. If a selected entrant cannot be contacted by mail, e-mail or telephone or fails to return the Contest documents within the specified time, he/she will forfeit their prize and an alternate winner will be selected. All decisions of the Contest judges will be final. Prize must be accepted as awarded and is not transferable. No substitutions except in Sponsor’s sole discretion. Prize will be delivered to Contest winner. By entering the Contest the prize winner consents to the use of his or her name, city of residence, photograph, voice, likeness, image or any other aspect of his or her personality, for any publicity and programming purposes, commercial or otherwise, in all media used by YoWinner, without territorial or time limitations and without additional payment or compensation.
GENERAL
Neither the Sponsor nor the Contest administration and judging organization, are responsible for faulty, incorrect or mistranscribed phone/email transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion. Sponsor reserves the right to cancel or modify the promotion if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by Sponsor/judging agency/administrator, in their sole discretion.
This Contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering the Contest, participants agree to be bound by these official rules and by the decisions of the independent administration and judging organization, which shall be final on all matters relating to this Contest. All entries become the property of the Sponsor and none will be returned.
Contest Sponsor will not sell or transmit this information to third parties except for the purposes of administering the Contest. If for any reason, the online portion of the contest is not capable of being completed as planned including, but not limited to computer virus, bugs, tampering, technical failures or other causes beyond the control of the Sponsor, the Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend this Contest or the online portion of the Contest. Any attempt to deliberately damage any Web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. All entries made by robotic or other automated means will be disqualified.
Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including, but not limited to, Contest entry services) will void all entries by that entrant.
For residents of the province of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties to reach a settlement.
